National Guard Youth Challenge Program|Blamed for Sex Assault & Death Threat

ANNISTON, Ala. (CN) - A teen-ager in the Alabama National Guard Youth Challenge Academy says he was forced to perform oral sex on a senior cadet under threats of death. The teen says the program at Fort McClellan was full of cadets with criminal records and gang affiliations.

Plaintiff T.W. says the senior cadet in charge made him perform oral sex while holding a pair of scissors to his chest and told him he would kill him if he told anyone.

T.W. says he complained to several adult officers, who ignored him. When his mother learned of the assaults, she removed him from the program and asked why the Guard had not investigated. A sergeant allegedly told her that the senior cadet was known to "blow up" and they did not want to provoke him.

The mother filed a police report, but says program officials refused to cooperate with the investigation and no charges were filed.

T.W. and his mom sued the United States of America and IIF Data Solutions, which supplied staffing for the National Guard Youth Challenge Academy at Fort McClellan, in Anniston. They demand damages for negligence under the Federal Tort Claims Act.

They are represented by Samuel Fisher of Birmingham.
