CHICAGO (CN) - An Illinois appellate court denied unemployment benefits to a nursing assistant who was fired for falling asleep while monitoring 25 residents at a nursing home.
When a visitor shook Marlene Odie awake to tell her that a resident was screaming for help, Odie replied, "she do that all the time," referring to the hysterical resident. The court viewed her nonchalant reaction as an indication that her napping was intentional and not an involuntary result of taking Tylenol, as she had claimed. See ruling.
