N.Y. Appellate Divisions

LABOR - The appellate division dismissed claims that businesses lost money because the Metropolitan Transit Authority used improper negotiation tactics that led to the 2005 transit strike. Plaintiff businesses failed to comply with the pleading and notice of claim requirements of Public Authorities Law. Also, the claim that the MTA committed an unspecified intentional tort by addressing pension issues in collective bargaining negotiations should have been dismissed because there is no private cause of action under the state labor relations law. See ruling.
