N.Y. Appellate Divisions

FRAUD, ATTORNEYS- The appellate division found that plaintiff's fraud-by-omission claim against Chase Bank should have been dismissed because an omission does not constitute fraud unless there is a fiduciary relationship between the parties. The court also dismissed plaintiff's claim against an attorney who represented the buyer in a transaction in which plaintiff sold her home, but claims she only intended to refinance it. See ruling.
