N.Y. Appellate Divisions

ENVIRONMENT - The appellate division held that the chairman of Long Island Power Authority's board of trustees was properly allowed to enter into a power-purchase agreement for the construction and operation of a combustion turbine generator on a 15-acre parcel of land. None of appellants had standing to challenge the deal. See ruling.

ELECTIONS - The appellate division found that 40 votes recorded over the maximum possible number were properly attributed to human error rather than tampering. Even if all of the 40 extra votes were cast for the winning Democratic town council candidate, she would still be the winner by four votes. Affirmed. See ruling.
