N.Y. Appellate Divisions

EMPLOYMENT - The appellate division upheld the New York Fire Department's decision to fire a firefighter who tested positive for cocaine during a random drug test. The penalty does not shock the conscience, the court ruled, as the decision was based on substantial evidence. Drug abuse does not qualify as a disability under the Human Rights Law. See ruling.
