DEFAMATION - The appellate division found that Elena Sassower's defamation action against The New York Times was properly dismissed. Editorial decisions about what goes into a newspaper and the decision to omit certain details are not actionable. Also, a fair and substantially accurate report of an official, judicial, or legislative proceeding cannot be the basis for a defamation action.
