ATTORNEYS, PROBATE - A lawyer stole $400,000 from his clients' three related estates and died within months of absconding the funds. Plaintiffs sued the lawyer's fellow attorney, who did not participate in the theft, because he failed to report the lawyer's misdeeds. The appellate court remanded to resolve whether the attorney was actually aware of any of the deceased lawyer's multiple thefts.
