MEDICAID - The appellate court found that an evidentiary hearing is required to determine whether the transfer of an elderly woman's home to her son was designed to avoid ineligibility from the Medicaid home-care program. The woman transferred the home to her grandson in exchange for $175,000 and a "lifetime lease" on the home's second-floor apartment. The director of the Division of Medical Assistance and Health Services imposed a 37-month Medicaid eligibility penalty period. See ruling.
