Mother Says 3 Club Workers Assaulted Her

AUSTIN (CN) - A 36-year-old mother of three says employees of an Austin nightclub sexually assaulted her. She sued the QUA Bottle Lounge, which advertises itself as a "proud advocate for responsible entertainment."

The woman seeks punitive damages for gross negligence and assault by offensive touching, in Travis County Court.

She says she became ill during a friend's birthday celebration, and the club's floor manager, "a man named Falco," told her friends that they had to get her out of the club. She says Falco assured them that he would "make sure she was safe" while they went to get the car.

The woman says that after losing consciousness, she recovered to find herself in an alley, with the floor manager standing over her, telling her to remain on her side. "There were two other men dressed in what looked like the QUA busboys' and dishwashers' uniforms bending over her and putting their hands down her pants, both from the front and from the rear, fondling her genitals and squeezing her breasts," according to the complaint.

When her friend returned, she found her "lying on the concrete outside the back door of the club."

She says the friend confronted the floor manager, who said, "I didn't do anything; maybe it was the busboy."

A police officer who investigated the women's complaint found "blood on the towels of one QUA employee and on the pants of another," according to the complaint.

But the woman says the officer "only issued tickets for Class C offensive touching to the two QUA employees" and did not cite the floor manager because the officer "appeared to believe" that woman had not been "raped."

She seeks punitive damages from The Downtown Austin Group dba Yassine Enterprises dba QUA Bottle Lounge. She is represented by Patrick Reznik with George & Brothers.
