Mother Can’t Sue School Over Son’s Baseball Death

(CN) - A woman whose son died during baseball practice cannot prevail on negligence charges stemming from the failure to adopt bylaws, a Florida appeals court ruled.

Matthew Miulli was practicing with his high school baseball team when he collapsed and died.

His mother, Kathleen, sued for wrongful death. She claimed that the Florida High School Athletic Association is required by law to adopt bylaws requiring medical examinations and prohibiting players from participating until the school approved the results.

The trial court dismissed Miulli's complaint, and Judge Palmer agreed.

"No private cause of action exists under (Florida law) for an alleged failure to enact or enforce a particular bylaw," Palmer wrote.
