WATER - The state high court found that the Montana Water Use Act does not create a private right of action to enforce the civil penalty provisions because the Legislature intended to make the Department of Natural Resources and Conservation, the attorney general or the county attorney the enforcer of the civil penalty provisions. Landowners in Gallatin County claimed Utility Solutions began pumping groundwater before the DNRC had granted final approval. See ruling.
