Montana Supreme Court

PROBATE - The state high court upheld the removal of a husband as the personal representative of his deceased wife's estate. When the wife wrote the will, she left her husband a quarter of more than $4 million in assets. The court found that the husband had his wife transfer significant assets into his name after her mental and physical health had deteriorated, dwindling her $4 million estate to $30,000 at the time of her death.
