GADSDEN, ALA. (CN) - Gadsden Police Officer Jake Mayo, angry because he could not communicate with a Spanish-speaking driver during an unjustified traffic stop, struck him in the head with a baton and killed him in the presence of his pregnant wife and two children, the man's family claims in Federal Court.
The Estate of Jose Manuel Ramirez Dominguez claims the wrongful death by excessive force was particularly pointless as Officer Mayo merely was claiming that Ramirez's name was different from the name on his insurance card. Mayo had already frisked Ramirez for weapons and Ramirez was peacefully cooperating when he was killed, the widow says.
The Ramirezes are represented by Henry Sherrod III.
