Mom Sues Daycare Center Over Tot’s Death

(CN) - A grieving Florida mother claims in court that the compound negligence of a reckless driver and popular daycare center led to the freak accident in which her four-year-old daughter was killed.

In a complaint filed in the Orange County, Fla. circuit court, Nicole Quintus says her daughter Lily was innocently attending class at a KinderCare Learning Center facility on April 9, 2014, when a vehicle driven by defendant Robert Corchado slammed into the rear of one driven by Albert Campbell.

"Immediately after the collision between Corchado vehicle and the Campbell vehicle, the Campbell vehicle turned to the right, traveled through the parking lot adjacent to the building and crashed into the building," Quintus says.

Quintus claims that Campbell's vehicle smashed into the west wall of the building near Golden Road where the initial collision occurred, and entered the structure at a high speed.

Quintus says that her daughter was killed when Campbell drove through portions of the day care center.

According to the complaint, the speed limit on Golden Road in front of the building is 45 mph, so a vehicle crashing into the building was foreseeable.

The complaint claims that prior to this incident "one or more vehicles crashed into other facilities owned or operated by defendant KinderCare Learning Centers LLC."

Quintus says that KinderCare had the responsibility to protect the children attending its school, including her daughter.

Quintus seeks compensatory damages on claims of negligence and premises liability.

She is represented by Mark Nation from The Nation Law Firm in Longwood, FL.

In response to an inquiry from Courthouse News, Colleen Moran, communications supervisor for Kindercare said the company does not comment on pending litigation.

"We take all allegations regarding the quality of care received in our centers very seriously, and fully investigate each and every allegation we receive. We view our families as extensions of our own, and the safety of the children in our care is always our utmost concern. If legitimate concerns are raised, we will always immediately address them, as we hold ourselves to the highest standards," Moran said.
