Mom Says Teacher Duct-Taped Her Son

BRONX, N.Y. (CN) - A mother claims in court that her son's public schoolteacher duct-taped the 12-year-old boy to his chair.

Lenora Cuffee sued New York City, its Department of Education, and teacher Marcy Rubenstein, in Bronx County Supreme Court.

Cuffee claims her son was duct-taped to his chair on March 23 at I.S. 339, at 1600 Webster Ave.

NBC's Channel 4 reportedon March 30 that the middle school student "says his teacher taped him to his chair and let students push him around during class."

According to NBC, the child "said the class was taking a math quiz and the teacher became irritated that he had gotten up from his seat several times - he says to help a classmate."

The NBC story continued: "So she took some tape, stretched it across his chest, 'and then she wrapped it around the chair, and again, and she bit it off and she stuck it to me, and she didn't take it off of me.'"

Cuffee pulled her son out of school, and Rubenstein was reassigned to a desk job, according to the NBC report. No charges have been filed against the teacher, according to NBC.

The New York Daily News reportedthat the child weighs 62 pounds and was taped for 20 minutes. The News identified Rubinstein as "a first-year instructor."

Cuffee and her son are represented by Rudyard Whyte, with The Cochran Firm.
