FORT WORTH (CN) - Salmonella poisoning from ConAgra Foods' peanut butter came from deplorable conditions at the company's Sylvester, Ga. plant, a mother claims on her son's behalf Tarrant County Court.
On behalf of her son mark, Sandra Gonzales claims ConAgra made its Peter Pan and Great Value peanut butter in a deteriorating building full of roof leaks and gaps large enough for rodents and insects to enter.
Gonzales claims ConAgra knew its peanut butter has tested positive for Salmonella as early as October 2004. She claims ConAgra withheld the test results when an FDA inspector visited the plant in February 2005.
ConAgra continued making peanut butter in these dangerous conditions, resulting in at least 714 Salmonella infections in 48 states from Aug. 1, 2006 through July 19, 2007, the complaint states.
During a court-ordered inspection of the Sylvester plant in August 2007, inspectors found "over 100 rat traps; rodent tracks on raw peanuts in the roasting room; dead insects, including dead roaches; a dead rodent; bird feathers and excrement; and roof damage and water leaks," the complaint states.
Plaintiffs demand punitive damages. They are represented by Ron Simon with Simon & Luke of Houston.
