Mom Claims Kaiser Doctor Abused Her Son

SANTA ANA, Calif. (CN) - A Kaiser doctor stroked a boy's penis and testicles during a bogus examination, the boy's mom claims in court.

Guardian ad litem Michelle Ferreira sued Dr. David Lee Parker and Kaiser Permanente on Dec. 17 in Orange County Court, alleging medical negligence, battery, sexual battery, intentional infliction of emotional distress and negligent infliction of emotional distress.

Ferreira claims that the boy, N, was taken to see Parker for hemorrhoids.

Parker told Ferreira he was "unfamiliar and not qualified to diagnose plaintiff's condition," and that she needed to make an appointment for N in another department, according to the complaint.

Ferreira claims that she left N alone with the doctor, whereupon "Parker abused his position of trust, forced plaintiff to disrobe and expose his penis and genitals while laying on his back, at which time Parker began to inappropriately touch and stroke his penis and testicles under the ruse that he was physically examining him. Parker did not utilize gloves, nor did he lubricate his finger(s) prior to this 'examination," the complaint states.

Ferreira claims that when the nurse came back, Parker moved quickly to the door and partially blocked it.

"When nurse Paul confronted Parker, plaintiff is informed and believes and thereon alleges, plaintiff heard Parker remark at this time words to the effect of, 'We'll have to pretend this didn't happen,'" the complaint states.

Ferreira claims that this was not the only time Parker had taken liberties with patients. She claims that Kaiser "either knew or should have known that Parker had engaged in the acts of sexual assault and battery upon former patients."

She seeks punitive damages.
