Model Says Plastic Surgeons Used His Photo|In Gay Magazine Without Permission

LOS ANGELES (CN) - A professional model claims four doctors used his photo on the back page of a gay magazine without his consent, to advertise their plastic surgery business. He says he never underwent any of the surgeries the doctors advertised in In Los Angeles Magazine.

Matthew Schaefer sued Drs. Arnold William Klein (and his medical corporation), Paul McAndrews, David Rish, Ilya Reter, and In Publications Inc., in Superior Court.

Schaefer says he did not discover that the defendants were using his image until September. He does not know how they did it, but adds that they never told him about it, they never had his permission, and he "has not undergone cosmetic procedures as listed in the picture."

"Additionally, the magazine cover on which plaintiff's picture was used is a 'gay' publication and it is this use cast's (sic) a 'false light' on plaintiff's sexual orientation causing further emotional distress," the complaint states.

Schaefer demands punitive damages. He is represented by Brian Breiten.
