Mistaken for a Thief

NEW YORK – A New York high school student arrested after being mistaken for a thief who repeatedly stole from Apple stores may pursue his defamation and malicious prosecution claims against the technology company and the security firm it employed, a federal court in the state ruled.

The thief was posing as the student using his lost learner’s permit – a ploy that worked even though the thief’s physical features did not match those of the student listed on the permit.
