Missouri Appeals Court

CIVIL PROCEDURE - The appeals court upheld the lower court's refusal to reduce Ozark Air Lines' $3 million award against Valley Oil Co. for breach of contract for its failure to provide a properly operating fuel farm. The award should not be adjusted to reflect pre-trial settlements from other defendants because the rule against double recovery only applies to tort claims. Affirmed. See ruling.
