The Ninth Circuit upheld a ruling against the Chilkat Indian Village of Klukwan and conservation organizations in their challenge of the Bureau of Land Management’s approval of a mineral exploration project.

SAN FRANCISCO — The Ninth Circuit upheld a ruling against the Chilkat Indian Village of Klukwan and conservation organizations in their challenge of the Bureau of Land Management’s approval of a mineral exploration project. 

The agency did not capriciously fail to consider the cumulative impacts of a future mine as a “reasonably foreseeable action.”
