Milk dealer's challenge sours

SCRANTON — A New Jersey dairy company lost its lawsuit challenging a Pennsylvania law that requires milk dealers to post an annual bond to buy milk from the state’s milk producers. Biazzo Dairy Products Inc. argued that it is forced to pay more than $500,000 to continue purchasing milk from Pennsylvania producers and had to fire 10 employees as a result. A federal judge threw out the company’s dormant Commerce Clause claims because both in-state and out-of-state milk dealers “shoulder the same burden.”
