Microsoft’s ‘Halo 3’ Game Crashes The Xbox, Class Action Claims

SAN DIEGO (CN) - Microsoft's highly touted "Halo 3" video game, made exclusively for its Xbox 360, causes the Xbox to freeze or crash, ruining the game, according to a federal class-action complaint. Microsoft and co-defendant Bungie, which makes Halo 3, reported $170 million in sales of Halo 3 on the day it was released, Sept. 27, and more than $300 million in sales in the first week.

Microsoft's "Halo 2" version was the fastest-selling video game in history, registering $125 million in sales the day it was released, in November 2004. That record was eclipsed by the new, allegedly defective, game.

Bungie LLC, which makes Halo, was acquired by Microsoft in May 1991. Bungie split off from Microsoft on Oct. 1, six days after Halo 3 was released, and became a privately held LLC. But Microsoft still "retains an ownership interest in Bungie, and Defendants collectively continue to manufacture and sell the Halo 3," the suit states.

Lead plaintiff Randy Nunez says he paid $59.99 for his game. He wants class certification and damages. He is represented by Bonnett, Fairbourn, Friedman & Balint of Phoenix and San Diego. See complaint.
