Microsoft faces some retaliation claims

DALLAS — A federal court in Texas partially dismissed a former Microsoft employee’s lawsuit alleging he was terminated in retaliation for refusing to perform illegal acts and for reporting unlawful conduct involving a federal contract. Microsoft argued the court lacks subject matter jurisdiction, but the National Defense Authorization Act’s requirement that litigants exhaust their administrative remedies is not a jurisdictional claim-processing rule.
