LOS ANGELES (CN) - A private school says the September 2008 Metrolink crash polluted its property with 3,000 gallons of diesel fuel, sulfuric acid and lead from two dozen batteries, and more than 150 pounds of biomedical waste.
Chatsworth Hills Academy said the Metrolink crash caused at least $87,000 in damages to its property. It says Metrolink, Los Angeles County Metropolitan Transportation Authority, and Union Pacific Railroad denied its requests for compensation, so it was forced to file this claim in Superior Court.
The train engineer allegedly was sending text messages just seconds before crash that killed 25 people.
The school says Metrolink and the other defendants trespassed by causing the spill, which "allowed or caused persons, equipment, machinery, and vehicles to come onto School Property without (the Academy's) consent."
It seeks $87,000, plus interest and costs. It is represented by Eric Bennett.
