Medical monitoring suit revived

RICHMOND, Va. — The Fourth Circuit reversed a lower court’s ruling in favor of Union Carbide Corp. and Covestro LLC in a proposed class action over a West Virginia plant that allegedly exposed nearby residents to ethylene oxide, a gas that causes cancer. The appeals court ruled that the residents’ ongoing diagnostic and monitoring costs qualify as immediate harm, so they have standing to pursue their claim for medical monitoring.
