JEFFERSON CITY, Mo. (CN) - The Missouri Supreme Court will decide whether to overturn limits on medical malpractice cases. The court has scheduled arguments in a case that challenges a 2005 law that set a flat $350,000 cap for non-economic damages, such as pain and suffering.
The previous limit was $579,000, which included an annual adjustment for inflation.
Former Republican Gov. Matt Blunt made the cap a priority.
Blunt and a Republican-led Legislature claimed the cap was needed to control the costs of liability insurance for doctors and other medical providers.
