Medicaid intermediaries

MANHATTAN — The Second Circuit affirmed a New York federal court’s rejection of takings claims brought by companies that served as “fiscal intermediaries” assisting Medicaid recipients with disabilities in choosing providers to help them with daily living under the state’s Consumer Directed Personal Assistance Program. There was no taking of private property when Governor Kathy Hochul opted for a single company to provide the oversight, nor were the firms’ “reasonable expectations” under their contracts disrupted.
