RICHMOND, Va. (CN) - John McCain's campaign claims the Virginia State Board of Elections failed to ensure that military voters overseas would get absentee ballots by Sept. 20.
Sen. McCain says many service members in Iraq and Afghanistan support him and he will be harmed if they are denied their right to vote.
The federal complaint cites the Uniform and Overseas Citizens Absentee Voting Act of 1986, which the Election Assistance Commission clarified in 2004 to state that election boards must mail absentee ballots to voters at least 45 days before the election. Virginia's deadline was Sept. 20, but McCain says the ballots were not sent until the 30th.
McCain asks that local electoral boards preserve and document absentee ballots, count them as valid votes, and accept ballots sent by today, and received by Nov. 14. McCain is represented by William Hurd with Troutman Sanders.
