Marijuana Shop Should Warn About Smoke

OAKLAND, Calif. (CN) - A Californian sued a medical marijuana dispensary on Christmas Eve, claiming it violates the state's Proposition 65, which requires businesses to warn customers about potentially carcinogenic products.

Michael Dipirro sued Go Green Bear dba 420 Kush N Wax Connection in Alameda County Court, claiming it does not warn its customers that marijuana smoke may be carcinogenic.

California voters approved Prop. 65 in 1986, as a section of the state's Safe Drinking Water and Toxic Enforcement Act. The law made it illegal for California businesses to "knowingly and intentionally expose any individual to a chemical known to the state to cause cancer or reproductive toxicity without first giving clear and reasonable warning."

Dipirro seeks statutory penalties of $2,500 a day for each violation, and corrective action.

He is represented by Jennifer Henry, with Bush and Henry in Santa Rosa. She did not immediately respond to an email request for comment Monday evening.
