Man Tells WaMu to Give Back His $90,000

CHICAGO (CN) - Washington Mutual fired an employee for stealing money from a customer's account, but won't give the customer his $90,000 back, the man claims in Federal Court.

Daniel Knox dba Universal Crown Real Estate says he did not receive bank statements after he deposited the money into his business account in March 2007, and that the bank never notified him of the unauthorized withdrawal.

Knox says Washington Mutual sent him a letter in October 2008 after its employee took another $1,650 from his account, but did not mention the $90,000 withdrawal. Knox claims that the bank employee who opened his account for him, Biron Dotson, also misappropriated his money, and the bank fired him for it. He claims that WaMu ignored his complaints about the missing $90,000, and that "WAMU required Plaintiff to file a written complaint more than one year after its investigation revealed misappropriation by its employee solely so it could reject plaintiff's claim in writing within the 10 day period required by law."

Knox wants his $91,650 back, and treble damages.

He is represented by David Neely.
