Man Sues to Keep Using Ashley Madison

CHICAGO (CN) - A Chicago-area man is upset that his personal information was made public in the Ashley Madison data hack, but he's suing the company for something else - so that he can keep using the cheating site.

Avid Life Media Inc., which runs Ashley Madison, was hit with a federal class action lawsuit August 24 after a group of hackers called Impact Team breached the site and dumped roughly 37 million users' information on the internet.

Matthew Lisuzzo sued the Canadian company in Cook County Circuit Court for failing to keep his information safe, but also because he "desires to continue to use AM and AM's services, spend the credits he already purchased from AM, and purchase additional credits."

It was revealed in the hack that tens of thousands of female profiles on the site were not real women, and "the fake accounts sent messages to more than 20 million of the 31 million AM male members," says the lawsuit. Employees of Avid Life Media also admitted to creating and maintaining the profiles.

Lisuzzo, who registered with the site in 2008, says he "has received communications and spent money attempting to communicate with fake female profiles."

According to the complaint, he also "had credits remaining on his account to spend on communications with other AM members" but hasn't been able to do so since the security of the website is lacking.

Impact Team told the technology news site Motherboard that the hack was simple because there was little to no security to bypass in the first place.

Lisuzzo is asking for an injunction to force Avid Life Media to provide secure and encrypted data storage and delete all of its fake female profiles so that he can "continue to use the services" and communicate with "real female AM members." He is also suing for Consumer Fraud and is represented by Zimmerman Law Offices and Ferril Law Firm.
