Man Sues School Over Alleged Past Abuse

MADISON, Wis. (CN) - A 38-year-old man claims he was sexually abused by his seventh-grade teacher, in part because the Madison Metropolitan School District failed to investigate the teacher's history of sexual abuse at Catholic schools in Kentucky and Wisconsin.

In a lawsuit in Dane County Court, Robert Heinz claims Gary Kazmarek molested him in 1981 and 1982.

"In 2004, Gary Kazmarek pleaded guilty to 14 counts of indecent or immoral practices with another, admitting he sexually abused five boys he coached or taught at Our Mother of Sorrows in Louisville, Kentucky between 1968 and 1973," the lawsuit claims. "After Kazmarek left Our Mother of Sorrows he then went to teach at Cherokee Heights School, where he abused Plaintiff."

Before teaching at Cherokee, Kazmarek allegedly abused boys at Catholic schools in Milwaukee and Middleton, Wis.

Heinz seeks damages for his past and future pain and suffering, health care and wage loss.

His attorney is Richard Jasperson.
