Man Claims Deputy Stalked His Late Son

ALBUQUERQUE (CN) - A man claims Bernalillo County Sheriff's Deputy Evangeline Martinez stalked his son and killed him, or caused him to die by jumping from her moving car to escape her as she was armed and upset with him because he wanted to break up with her.

Gary Hoodless also sued the County, its Sheriff Daren White and Farmers Insurance, on behalf of his son, Gary Jr. He claims Martinez pushed, or threatened and assaulted and caused his son to jump from her car in the early morning of March 11.

"Prior to this incident, Martinez, who had been dating Decedent, had been stalking him, threatening him, intimidating him, and displaying and brandishing firearms to him in a threatening manner for some period of time. This conduct intensified subsequent to Decedent's advising her he was no longer interested in continuing to have a romantic relationship with her."

He claims Martinez had a history of domestic violence, having been charged with breaking into the home of a man with whom she had been involved, and who also sought to break off the relationship. He claims Bernalillo County negligently allowed her to keep her job as a deputy after this case was dismissed upon her completion of a domestic violence early intervention program.
