Man Calls Sexual Harassment Unbearable

FAIRFIELD, Calif. (CN) - A worker claims his company fired him after he suffered months of sexual harassment from a co-worker who threatened to kill him and his wife and children unless he had sex with her.

In his complaint in Solano County Court, Donald Clay claims PSC Environmental Services did not respond to his repeated complaints about co-defendant Tina Carter, a customer service rep.

Clay claims that in "an increasing pattern of unrelenting harassment," Carter called him at "all hours of the day and night" on his company cell phone, "sometimes constantly redialing for over an hour." He claims that Carter demanded "a physical relationship," insulted him "for rejecting her advances," and threatened "to kill plaintiff and his wife if he did not give in to her demands."

The complaint states: "Some messages by Carter to plaintiff stated: 'I will kill you and your wife; you guys will both be on the news and you will be found dead in a ditch, and your kids will have no parents'; 'when a woman approaches you, you should just go ahead and give her what she wants and stop being a f_ing ass,' and 'nobody's going to believe you; you're a dude and I'm a chick.'"

After six months of this, Clay says he suffered panic attacks, and when he complained to supervisors, they told him to "give it some time."

Clay says that despite his complaints to the bosses, Carter's calls continued and got even more aggressive, and that the company eventually fired him.

He seeks punitive damages for gender discrimination, sexual harassment, hostile work environment, wrongful termination, failure to prevent discrimination, harassment and retaliation, negligent hiring and retention, and intentional infliction of emotional distress.
