Mall Owner Lowers Boom on Vegas Theater

LAS VEGAS (CN) - The United Artists Theatre on the Las Vegas Strip has falsely accused its landlord of breaching their lease in a poorly disguised attempt to stop the financial hemorrhaging of "one of the worst-performing movie theaters in the Las Vegas valley and one of the worst in its entire nationwide portfolio," the Showcase Mall owner claims in Federal Court.

United Artists has allegedly been threatening to shut down the theater, claiming its landlord, CCR/AG Showcase Phase I Owner LLC, constructively evicted it. But the owner says it's more likely that United Artists wants an excuse to get rid of a theater that this year lost $600,000 by mid-2008.

Phase I Owner wants to hold United Artists to its lease, adding that any complaints the theater might have are its own doing. The theater allegedly refused to move to a nicer spot with newer amenities, which cost it business to upgraded theaters.

The plaintiff is represented by Boies, Schiller & Flexner of Las Vegas and Duval & Stachenfeld of New York.
