Malibu, Culver City’s FAA challenge flounders

SAN FRANCISCO — The Ninth Circuit dismissed Malibu and Culver City’s petitions for review of a Federal Aviation Administration decision related to its Next Generation Air Transportation System, which seeks to revise air traffic and flight procedures. The cities’ challenges to 2016 flight procedures are untimely, but their challenges to 2018 amendments may proceed. Further, Culver City has not shown it has suffered an injury, while Malibu only demonstrated standing to challenge those untimely 2016 procedures.
