Making Child Porn in the Workplace

WAUKEGAN, Ill. (CN) - An employee used a software company's on-site exercise and video rooms to sexually assault an 8-year-old girl - and film himself doing it, the girl's mother claims in court.

Jane Doe and her mother Jane Doe sued Omnicell and Kevin Stirnichuk in Lake County Court.

Omnicell sells automation services and healthcare software to hospitals and other medical providers from its offices in Waukegan.

Stirnichuk pleaded guilty in February to predatory criminal sexual assault of a minor and child pornography, according to the complaint.

"Omnicell's self-contained office building included an exercise room and a separate video room for the use of employees, including co-defendant Stirnichuk," the lawsuit states.

"At that place and time, defendant Omnicell allowed access by co-defendant Stirnichuk to the defendant's office building, including the exercise and video room on a 24-hour/7 day-a-week/365 days-a-year basis.

"The minor plaintiff was born on April 21, 2004 and was the ages of eight to nine at all relevant times herein.

"At that place and time and at all relevant times herein, co-defendant Stirnichuk was an adult born on August 9, 1960.

"On multiple occasions at that place and time, co-defendant Stirnichuk physically brought the minor plaintiff to the defendant Omnicell's offices and the exercise and video room.

"At that place and time, on multiple occasions, co-defendant Stirnichuk sexually assaulted the minor plaintiff in the defendant's exercise and video rooms and preserved all or a portion of the sexual assaults via computer video photography."

Omnicell negligently "allowed its employee, co-defendant Stirnichuk to sexually assault the minor plaintiff at its office building," and "failed to provide adequate monitoring of its company office exercise and video rooms," Doe says in the complaint.

Doe seeks damages for negligence, child pornography, criminal sexual assault, and other charges.

She is represented by Scott Gibson of Waukegan.
