BRONX, N.Y. (CN) - A Major League umpire sued Wilson Sporting Goods, claiming he suffered a concussion when his face mask cracked on a foul tip by a Cleveland Indians batter as the ump called a game in Yankee Stadium.
Edwin Hickox was calling a Yankees-Indians night game on April 18, 2009, when the Indians' Ben Francisco tipped a foul ball in the top of the sixth inning, Hickox says in his complaint in Bronx County Supreme Court.
"As a result of the impact, defendant Wilson's mask cracked severely and was fractured into separate pieces," the complaint states. "This was a malfunction of the mask which was designed to protect plaintiff Edward Hickox. Instead of protecting Mr. Hickox, the mask itself fractured from the impact."
Hickox says the impact left him with a concussion, injuries to his left ear and a closed head injury, causing him to miss work and rack up medical bills.
The Yanks were clobbered that night, 24 to 4.
Hickox and his wife seek damages and punitive damages from Wilson Sporting Goods and Amer Sports Corp., for personal injury, breach of warranty, defective design, false advertising, and other charges.
The Hickoxes are represented by Howard Richman, with Grant Richman.
Hickox, 60, became a Major League umpire in 1990.
