Lumber Companies Sue Interior Secretary

WASHINGTON (CN) - Lumber companies sued Interior Secretary Dirk Kempthorne, challenging a Final Rule designating critical habitat for the northern spotted owl on 5.3 million acres in Oregon and the Northwest.

The lumber companies claim the Secretary arbitrarily and capriciously reduced the value of their property, in violation of the National Environmental Policy Act, the Regulatory Flexibility Act, and the Unfunded Mandates Reform Act.

They are represented by James McDermott with Ball Janik of Portland, Ore.
