LAS VEGAS (CN) - Former North Las Vegas City Councilman Richard Cherchio has challenged the June election that he lost by 1 vote to newcomer Wade Wagner.
The City Council, along with Cherchio, who refused to step down, voted this month to hold another, special election, but a judge killed that plan, saying the city should instead canvass and certify the votes.
The Clark County Election Department recounted the votes on July 22, and Wagner won by 1 vote.
But in a lawsuit he filed Wednesday in Clark County Court, Cherchio claims the recount was incomplete, and that at least 3 residents voted in the Ward 4 election though they lived in another ward.
Wagner got 1,831 votes to Cherchio's 1,830 in the June 7 general election.
Clark County Registrar Larry Lomax said at the time that at least 1 illegal ballot had been cast in the precinct, but he could not say for whom.
Both Cherchio and Wagner sued over the issue.
Cherchio is represented by Bradley Schrager with Jones Vargas.
