Loose Screen Blamed for Boy’s Death

(CN) - A 5-year-old boy fell three stories to his death because of shoddily installed window screens in a Miami apartment, his mother claims in court.

Cindy Farmer sued Magnolia Landing Apartments and Allied Window, which was dissolved after her son Kristopher's death, according to the complaint in Miami-Dade County Court.

Cindy Farmer claims Allied installed window screens during construction without proper retaining clips.

On Feb. 21, 2012, she says, Kristopher was in the apartment's bedroom with the window open when something outside caught his attention.

He leaned against the screen to see what he'd heard.

"Because of the missing retention clips, the window screen fell out at the slightest pressure, and Kristopher fell out of the third story window to the ground below, sustaining grievous injuries," the mother says.

He lingered for five days in a hospital and died of his injuries on Feb. 26.

His mother seeks damages for wrongful death, and court costs.
