The 11th Circuit remanded a suit brought by several hospitals against the U.S. Department of Health and Human Services relating to the agency’s adoption of a new policy for allocating donated livers. 

ATLANTA – The 11th Circuit remanded a suit brought by several hospitals against the U.S. Department of Health and Human Services relating to the agency’s adoption of a new policy for allocating donated livers. 

The circuit court finds that the lower court should consider whether the department’s actions in adopting the policy were “arbitrary and capricious and deprived the hospitals of due process.
