License Suspension

An appeals court in California reversed the denial of a petition to compel the Department of Motor Vehicles to discontinue their practice of automatic license suspension upon receipt of a notification of failure to appear. Statute requires a finding the person willfully violated his or her promise to appear, which is not satisfied by the DMV’s reliance on automatic notifications from traffic courts.
