License plate data lawsuit fails in California

SAN DIEGO — An appeals court in California upheld the trial court’s finding that a driver lacked standing under the Automated License Plate Recognition statute to sue for the collection and storage of his data. He claimed the collection and storage of data about his movements without notice or consent violated his privacy rights in itself, but he failed to cite any actual direct harm from alleged violations of the law, and his subject belief he was harmed is not a basis for standing.
