(CN) - A British horse racer who angrily smashed a glass table and told a race official he wanted her to die a slow death cannot sue for a license, a New York appeals court ruled.
The New York State Racing and Wagering Board refused in 2005, 2006 and 2009 to grant licensing applications from Graham Lewis, a native of Great Britain, to work as a driver and trainer.
In 2006, the board found that Lewis had not documented his ability to work in the United States.
While appealing that decision before the board, Lewis "smashed a glass tabletop, confronted and threatened a hearing officer, and informed respondent's investigator that he wished she would die a slow, horrible death," according to the opinion authored by Justice William McCarthy.
Citing these events, the board found that Lewis lacked the character and fitness to participate in harness racing when he applied for a license again in 2009.
The board ruled that Lewis is not even allowed to visit the state's harness racing tracks as a customer.
"Under these circumstances, we conclude that respondent's denial of petitioner's license application is supported by substantial evidence and will not be disturbed," McCarthy wrote.
