Library Page Didn’t Need Drug Test, Court Rules

SAN FRANCISCO (CN) - The 9th Circuit struck down the drug-test policy of Woodburn, Calif., ruling that the city unconstitutionally forced an applicant for a part-time library page position to take a drug test. The court rejected the city's claim that the library page position was "safety-sensitive," and said Woodburn "failed to demonstrate a special need to screen a prospective page for drugs."

But the judges did not rule out the possibility that the drug policy could be acceptable for other city positions.
