Lego Can’t Trademark Blocks, EU Court Rules

(CN) - Lego is unable to register a trademark for the shape of a Lego brick, the Court of First Instance ruled. Europe's second-highest court rejected Lego's bid to stop the Office for Harmonization in the Internal Market from cancelling its trademark.

Mega Brands, which makes the rival Mega Bloks, originally applied for the cancellation of Lego's trademark for construction toys.

The court agreed with the OHIM that the shape is functional and necessary to achieve a technical result.
