Legal Secretary

A federal court in Texas recommended against dismissal of a lawsuit brought against a Texas Court of Criminal Appeals judge by a former legal secretary who claims she was fired because the judge disagreed with political views she posted on Facebook. While Judge Kevin Patrick Yeary claims qualified immunity, the court cannot reach that conclusion based on the facts in the complaint. 

AUSTIN, Texas – A federal court in Texas recommended against dismissal of a lawsuit brought against a Texas Court of Criminal Appeals judge by a former legal secretary who claims she was fired because the judge disagreed with political views she posted on Facebook. While Judge Kevin Patrick Yeary claims qualified immunity, the court cannot reach that conclusion based on the facts in the complaint.
